Terms and Conditions
Welcome to Zekolah, an educational products and services platform owned and operated by 30 EdTech Sdn Bhd. By accessing or using our website (the “Site”) and services (collectively, the “Services”), you agree to comply with and be bound by these terms and conditions (the “Terms”). Please read these Terms carefully before using the Services.
1. Acceptance of Terms
By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Services.
2. Changes to Terms
Zekolah reserves the right to update or modify these Terms from time to time. Any changes will take effect once they are posted on the Site. Your continued use of the Services after any changes are posted constitutes your acceptance of the updated Terms.
3. Products and Services
Zekolah offers educational products and services, including but not limited to digital products such as downloadable PDFs and online courses, as well as printed or hard-copy educational materials (collectively, the “Products”).
Products may be offered in digital format, physical format, or as a combination of both. Product descriptions, contents, formats, prices and availability will be stated on the relevant product pages.
4. User Accounts
To access certain features of the Services, you may be required to create an account. You agree to provide accurate and complete information and to keep your information up to date.
You are responsible for maintaining the confidentiality of your account credentials and for all activities carried out through your account.
5. Use of Services
You agree to use the Services only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Services in violation of any applicable law or regulation.
- Engage in conduct that restricts or interferes with another person’s use or enjoyment of the Services, or that may harm Zekolah or its users.
- Use the Services in any manner that could disable, overburden, damage or impair the Site or interfere with its proper operation.
- Attempt to gain unauthorised access to any part of the Site, user accounts, systems or networks connected to the Services.
6. Intellectual Property
Unless otherwise stated, all content made available through the Services, including text, graphics, logos, images, software, educational materials and Products, is owned by or licensed to Zekolah and is protected by applicable intellectual property laws.
The purchase of a Product, whether digital or physical, does not transfer ownership of the intellectual property contained in that Product.
Except as permitted by these Terms or with prior written permission from Zekolah, you may not reproduce, distribute, modify, republish, resell or commercially exploit any content or Product made available through the Services.
7. Purchases and Payment
When you purchase a Product, you agree to pay the price, delivery charges, taxes and any other applicable charges shown at checkout.
Payments may be processed through third-party payment providers and may be subject to their respective terms and conditions.
Once an order has been confirmed, changes or cancellations may not be possible, particularly after a digital Product has been made available or a physical Product has begun processing.
Zekolah reserves the right to cancel or refuse an order if we are unable to fulfil it, if there is an obvious pricing or product information error, or if we reasonably suspect fraudulent or unauthorised activity. Where payment has already been made for an order cancelled by Zekolah, the applicable amount will be refunded.
Refunds, returns and replacements are subject to these Terms and applicable Malaysian law.
8. Digital Products and Licence
Upon successful purchase, digital Products will normally be made available through your Zekolah account, download link or other method specified on the Site.
Your purchase grants you a limited, non-exclusive, non-transferable and non-sublicensable licence to use the digital Product for personal, non-commercial educational purposes.
You may download and print digital Products for your personal use, but you may not share, reproduce, distribute, resell, upload or otherwise make the files or their contents available to others, whether for commercial purposes or otherwise, without prior written permission from Zekolah.
Due to the nature of digital Products, cancellations or refunds are generally not available once the digital Product has been made available to you, except where required by applicable law or where otherwise stated by Zekolah.
9. Physical Products, Shipping and Delivery
Physical Products will be delivered only to eligible delivery locations made available on the Site or at checkout.
Applicable delivery charges will be shown at checkout before payment is completed. Any estimated processing or delivery time provided by Zekolah is an estimate only and is not a guaranteed delivery date.
Zekolah will use reasonable efforts to process and dispatch orders within the stated timeframe. However, delivery may be affected by courier delays, public holidays, weather, events beyond our reasonable control or other circumstances outside Zekolah’s control.
Minor variations in printing, paper, binding, colour or finishing that do not materially affect the content or usability of a physical Product will not be considered a defect.
10. Returns, Damaged or Incorrect Physical Products
Unless otherwise stated, Zekolah does not accept returns, cancellations or refunds for physical Products solely due to a change of mind or because the customer selected the wrong Product, subject to applicable Malaysian law.
If a physical Product is received damaged, defective, incomplete or materially different from what was ordered, please contact Zekolah as soon as reasonably possible and provide your order number, details of the issue and, where appropriate, photographs of the Product and packaging.
Where a Product is confirmed to be damaged, defective, incomplete or incorrectly supplied, Zekolah may provide a replacement, refund or other appropriate remedy in accordance with these Terms and applicable Malaysian law.
Nothing in these Terms excludes, restricts or modifies any consumer rights or remedies that cannot lawfully be excluded or restricted.
11. Delivery Information and Failed Delivery
You are responsible for providing an accurate and complete recipient name, delivery address, postcode and contact information when placing an order.
If you notice an error in your delivery information, you should contact Zekolah as soon as possible. We will attempt to make the requested change, but we cannot guarantee that changes can be made once an order has been processed or dispatched.
If a parcel is returned to Zekolah due to an incorrect or incomplete address provided by the customer, refusal of delivery, failure to collect the parcel or another reason attributable to the recipient, the customer may be required to pay reasonable additional delivery or courier charges before the order is sent again.
The customer will not be responsible for additional delivery charges where the failed or incorrect delivery resulted from an error by Zekolah.
12. Termination
Zekolah may suspend or terminate your account or access to the Services if you breach these Terms, misuse the Services, engage in fraudulent or unlawful activity, or otherwise use the Services in a manner that may harm Zekolah or other users.
Where reasonably practicable, Zekolah may provide notice before suspending or terminating access. However, immediate action may be taken where necessary to protect the Site, the Services, Zekolah or its users.
Termination of an account does not affect any rights or obligations that arose before termination.
13. Disclaimer of Warranties
To the fullest extent permitted by applicable law, the Site and Services are provided on an “as is” and “as available” basis.
Zekolah does not guarantee that the Site or Services will always be available, uninterrupted, error-free or free from viruses or other harmful components.
While Zekolah takes reasonable care in preparing educational materials, we do not guarantee that any Product will result in any particular academic result, examination grade or learning outcome.
Nothing in these Terms excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded or restricted.
14. Limitation of Liability
To the fullest extent permitted by applicable law, Zekolah, its directors, employees and agents will not be liable for any indirect, incidental, special or consequential loss arising from your use of, or inability to use, the Site, Services or Products.
Zekolah will not be responsible for losses resulting from circumstances beyond our reasonable control, including interruptions to third-party services, payment systems, internet services or delivery services.
Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited under applicable Malaysian law.
15. Governing Law
These Terms are governed by and construed in accordance with the laws of Malaysia.
Any dispute arising from or relating to these Terms, the Services or the Products will be subject to the applicable laws and dispute-resolution procedures of Malaysia.
